These Terms and Conditions govern your use of Secuora's transaction-protection platform. By creating an account or using Secuora, you agree to them.

1About Secuora

Secuora is a technology platform designed to facilitate secure transactions between buyers and sellers.

Secuora may provide transaction management, verification, communication, evidence management and delivery-related functionality.

Where a third party provides escrow, payment, identity verification or courier services, those services remain subject to the relevant third party's terms.

2Acceptance

By creating an account or using Secuora, you agree to these Terms.

If you do not agree, you must not use the platform.

3Eligibility

You must provide accurate information and have the legal capacity to enter into transactions.

You must not create an account using another person's identity or provide false information.

4User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • Providing accurate information.
  • Keeping your account secure.
  • Reporting suspected unauthorised access.

You must not sell, transfer or share your account without Secuora's permission.

5Buyer Responsibilities

Buyers must:

  • Provide accurate information.
  • Review item information before committing to a transaction.
  • Make payments through approved payment methods.
  • Inspect items where applicable.
  • Report material issues within the applicable inspection period.
  • Provide truthful dispute evidence.

6Seller Responsibilities

Sellers must:

  • Own the item or have legal authority to sell it.
  • Provide accurate item information.
  • Disclose known defects or material issues.
  • Provide accurate serial numbers where applicable.
  • Provide authentic photographs and evidence.
  • Not misrepresent an item's condition, ownership or authenticity.
  • Cooperate with verification and dispute processes.

7Prohibited Transactions

Users may not use Secuora for:

  • Weapons or military-grade equipment
  • Illegal goods or services
  • Counterfeit goods
  • Human trafficking
  • Child labour
  • Prostitution
  • Adult entertainment where prohibited
  • Drug paraphernalia
  • CBD or prohibited controlled products
  • Cryptoassets
  • Gambling
  • Betting
  • Lottery or casino transactions
  • Ponzi or pyramid schemes
  • Money laundering
  • Terrorist financing
  • Fraud
  • Stolen goods
  • Unauthorised luxury-goods resale
  • Precious metals or stones where prohibited by our payment/escrow provider
  • Financial products or regulated financial services without appropriate authorisation
  • Any activity prohibited by our payment, escrow, banking or courier partners

Secuora may suspend or terminate transactions that violate these restrictions.

8Transaction Creation

A transaction may contain:

  • Buyer
  • Seller
  • Item
  • Transaction amount
  • Fees
  • Shipping costs
  • Transaction conditions
  • Verification requirements
  • Inspection period
  • Dispute conditions

The exact transaction workflow may vary depending on the services available.

9Escrow and Payment

Where Secuora integrates with a third-party escrow/payment provider, the relevant provider may receive and hold transaction funds.

Secuora does not guarantee that funds will be immediately available, released or withdrawn.

Release of funds is subject to:

  • The transaction workflow
  • Buyer acceptance
  • Delivery status
  • Dispute status
  • Provider rules
  • Fraud/security checks
  • Applicable legal requirements

10Shipping

Where shipping is available, Secuora may integrate with third-party courier providers.

Courier services are subject to the courier's terms, pricing, service availability and operational limitations.

Shipping costs may form part of the transaction amount where supported.

11Item Verification

Secuora may provide verification tools, including:

  • Serial-number verification
  • Evidence uploads
  • Photographs
  • Videos
  • Documents
  • Seller information
  • Buyer inspection evidence

Verification does not necessarily constitute a guarantee of authenticity, ownership, condition or value unless Secuora expressly states otherwise.

12Disputes

A buyer or seller may raise a dispute where permitted by the applicable transaction workflow.

Users must provide truthful and relevant evidence.

Secuora may review:

  • Transaction records
  • Messages
  • Photographs
  • Videos
  • Serial numbers
  • Documents
  • Delivery information
  • Payment records
  • Other relevant evidence

Funds may remain restricted while a dispute is being investigated.

13Fraud and Abuse

Secuora may suspend accounts, restrict transactions or request additional verification where it detects:

  • Suspicious activity
  • Fraud
  • Identity discrepancies
  • Payment abuse
  • Multiple accounts
  • False information
  • Manipulated evidence
  • Unusual transaction behaviour
  • Attempts to bypass transaction controls

14Fees

Applicable transaction, platform, verification, payment, escrow and other fees will be displayed before the user commits to the relevant transaction where reasonably practicable.

Fees may be paid by the buyer, seller or another party depending on the transaction configuration.

15Refunds

Refunds are subject to the transaction terms, applicable provider rules and the circumstances of the transaction.

Shipping charges may be non-refundable where the courier service has already been performed or charged.

16Third-Party Services

Secuora may integrate with third-party providers including:

  • Escrow/payment providers
  • Banks
  • Courier companies
  • Identity verification providers
  • Cloud infrastructure providers
  • Communication providers

Secuora is not responsible for failures caused by third-party systems outside our reasonable control.

17Platform Availability

We aim to maintain reliable availability but do not guarantee uninterrupted access.

The platform may occasionally be unavailable because of:

  • Maintenance
  • Security incidents
  • Third-party outages
  • Network failures
  • Infrastructure failures
  • Force majeure events

18Intellectual Property

Secuora's software, branding, logos, interface, designs, content and technology are owned by or licensed to Secuora.

Users receive a limited, non-exclusive right to use the platform for its intended purpose.

19User Content

You retain ownership of content you submit, subject to granting Secuora the necessary rights to store, process and display that content to provide the service.

You must have the right to submit the content.

20Limitation of Liability

To the maximum extent permitted by applicable law, Secuora will not be liable for indirect, incidental, special or consequential losses arising from:

  • Third-party payment failures
  • Courier failures
  • Internet/network failures
  • User fraud
  • Incorrect information supplied by users
  • Unauthorised account access caused by user negligence
  • Events outside Secuora's reasonable control

Nothing in these Terms excludes liability that cannot legally be excluded.

21Suspension and Termination

Secuora may suspend or terminate an account where:

  • These Terms are breached.
  • Fraud is suspected.
  • A transaction violates prohibited-activity rules.
  • Required verification is not completed.
  • The account creates security or regulatory risk.

Termination does not automatically cancel obligations arising from transactions already initiated.

22Changes to These Terms

We may update these Terms from time to time.

Material changes will be communicated through reasonable means.

Continued use after the effective date of updated Terms constitutes acceptance where legally permitted.

23Governing Law

These Terms are governed by the laws of the Republic of South Africa, unless applicable law requires otherwise.
